This is a sacred agreement first and foremost, and a legal agreement to make sure we are both clear on important issues like for example the no-refunds policy, intellectual property rights, confidentiality, and liability.

 

• I am totally committed to growing my business. I show up to the 1:1 sessions with Myka/Elizabeth with an open willingness to learn and a readiness to take real action in my business.

• I am 100% committed to doing the work to build my business and staying accountable to completing the the Action Items in-between 1:1 sessions.

• I know that one of the biggest things holding me back in my business is a mindset or behavior I am stuck in, and that growing out of this pattern may not be easy or comfortable. I trust these growing pains.

• I show up to each 1:1 session on time, and at my computer, in a quiet place, so I can give my full attention to building my business. If I am late to my 1:1 session for any reason, I understand I am losing time I paid for.

• If I am unable to continue being part of the Program, I commit to coming to one more session with Myka/Elizabeth to say goodbye so that we can have a nourishing sense of closure.

• My business is my responsibility. I do not hold WINC or Myka/Elizabeth accountable or liable for any action or decision I make in my own business.

• I understand that Myka/Elizabeth significantly limits the number of women she works with. Thus I understand that by saying Yes to working with Myka/Elizabeth I have taken time in her calendar that another woman could have benefited from, so I fully understand that I am making a non-refundable purchase.

• I commit to showing up with my heart and my honesty and my dedication to my vision and my business. If I am not getting what I need in the sessions with Myka/Elizabeth, I will speak up and let her know, so that together we can course correct and have an awesome working experience together.

 

By signing where indicated below, you irrevocably agree that, if WINC, (the “Company” or “we/us”) accepts you as a private client (the “Private Program”), then this WINC Private Client Agreement (the “Agreement”) automatically becomes a binding contract between you and the Company, and applies to your participation in the WINC Private Program. By signing below, you are acknowledging that you have read, agree to, and accept all of the terms and conditions contained in this Agreement. We may amend this Agreement at any time by sending you a revised version at the email address you provided at time of payment.

By signing below, you authorize the Company to charge your credit, debit card, or cash your check, as payment for the membership in the Private Program. Furthermore, you agree that if you are accepted as a Private Client Program, you are responsible for full payment of fees for the all the private sessions you committed to, regardless of whether you actually attend or complete the private sessions you paid for. To further clarify, no refunds will be issued.

We are committed to providing all of WINC’s Program participants with a positive experience. By signing below, you agree that the Company may, at its sole discretion terminate this agreement, and limit, suspend or terminate your participation the Program without refund or forgiveness of the remaining payments if you become disruptive or difficult to work with, if you fail to follow the Program guidelines, or if you impair the participation of Program instructors or participants in the Program.

We respect your privacy and must insist that you respect the privacy of WINC and fellow Program participants. By signing below, you agree not to violate the publicity or privacy rights of any Program participant. We respect your confidential and proprietary information ideas, plans and trade secrets (collectively, “confidential information”) and must insist that you respect the same rights of fellow Program participants and of the Company. By signing below, you agree (1) not to infringe on Program participants or the Company’s copyright, patent, trademark, trade secret or other intellectual property rights, (2) that any Confidential Information shared by Program participants or any representative of the Company is confidential and Proprietary and belongs solely and exclusively to the Participant who discloses it or the Company, (3) not to disclose such information to any other person or use it in any manner other than in discussion with other Program participants during Program sessions. By signing below, you further agree that (4) all materials and information provided to you by the Company are its confidential and proprietary intellectual property belong solely and exclusively to the Company and may only be used by you as authorized by the Company, and (5) the reproduction, distribution and sale of these materials by anyone but the Company is strictly prohibited. Further, by signing below, you agree that, if you violate, or display any likelihood of violating any of your agreements contained in this paragraph the Company and/or the other Program participant(s) will be entitled to injunctive relief to prohibit any such violations to protect against the harm of such violations.

We have made every effort to accurately represent the Private Program and its potential. Claims of actual earnings can be verified and examples of actual results can be provided upon request. The testimonials and examples used are not intended to represent or guarantee that anyone will achieve the same or similar results. Each individual’s success depends on many factors, including his or her background, dedication, desire, and motivation. By signing below, you acknowledge that as with any business endeavor, there is an inherent risk of loss of capital and there is no guarantee that you will earn any money as a result of the Participation in the Private Program. By signing below, you also acknowledge that you have represented to the Company that payment of your Program membership fees will not place a significant financial burden on you or your family.


Thank you for your Agreement. Once we have received your signed Agreement and your payment (either full payment or the deposit for your payment plan option), we will send you all the details for your WINC Private Program. Look for the Magic – because it truly starts now!
